Terms of Use:

1. By accepting an appointment or quote The Customer is accepting all terms and conditions
2. All prices quoted are in Australian Dollars and are subject to change without notice. Unless otherwise stated, quotes provided are exclusive of any GST and do not include any other taxes, excise, duties on imports imposed by any government, delivery costs or delivery insurance. Tax invoices will be issued in accordance with the GST law and any GST will be shown as a separate line on a tax invoice when issued.
3. Unless the customer is an approved credit account customer, payment shall be made in advance of shipment for goods or at the completion of an appointment for services by cash, cheque or direct deposit.
4. If SolutionOne allows The Customer a credit account then:
4.1 The Customer must pay each invoice in full without deduction, set off or withholding within 14 days of the date of the invoice unless otherwise agreed upon and issued in writing by SolutionOne.
4.2 If the customer has
(a) defaulted on due payment of an invoice and
(b) The Customer as not raised a dispute in respect of that invoice in writing within 7 days of receiving it (c) SolutionOne reserves the right to charge a 1.5% service fee for each month or portion thereafter on monies that are overdue
5. A 15% restocking fee will apply to all returned goods
6. All goods remain the property of SolutionOne until fully paid for
7. Return/Repair of faulty goods is to go directly to the manufacturer unless otherwise agreed upon with SolutionOne
8. All costs of shipping, handling and insurance will be covered by The Customer including costs incurred by SolutionOne from its suppliers with respect to The Customer’s order
9. Limitation of Liability:
(a) Some laws, such as the Trade Practices Act 1974 (‘TPA’) and corresponding State laws, may create rights or remedies that cannot be excluded, restricted, modified or limited.
(b) ‘Non-Excludable Term’ means any warranty or condition that is implied in this agreement by the TPA or otherwise, to the extent to which
(i) it may not lawfully be excluded, restricted, modified or limited or
(ii) any exclusion, restriction, modification or limitation of it is void.
(c) ‘Non-Excludable Right’ means:
(i) a Non-Excludable Term; and
(ii) any law or its application, and any right or exercise of a right conferred by any law, (including but not limited to the TPA) to the extent to which
(A) it may not lawfully be excluded, restricted, modified or limited or
(B) any exclusion, restriction, modification or limitation of it is void.
(d) ‘Non-Excludable Liability’ means any liability to the extent to which
(a) it may not lawfully be excluded, restricted, modified or limited or
(b) any exclusion, restriction, modification or limitation of it is void.
10. To the extent permitted by law, SolutionOne will not be liable to The Customer or any other person under any circumstances for any loss of profit, revenue, interest, goodwill or data, or for any injury, death to any person or for any indirect incidental or consequential damages sustained or incurred by The Customer whether such liability arises directly or indirectly as a result of:
10.1 any negligent act or omission or wilful misconduct of SolutionOne or its employees or agents
10.2 the supply, performance or user of any products or services or
10.3 any breach by SolutionOne of its obligations under these Terms or any relevant Sales Contract. 11. SolutionOne will not refund amounts paid for services actually rendered.
